Terms and Conditions

1. Definitions

“The Local IT Guy”, “We”, “Us”, or “Our” refers to The Local IT Guy (Pty) Ltd, company registration number 2019/100297/07, with registered address at Unit 10 Bronze Micro Park, 11 Brons Crescent, Clayville, 1666, Gauteng.

“Customer”, “You”, or “Your” refers to the individual or business entity entering into this agreement.

“Equipment” refers to all Yoco POS hardware including but not limited to tablets, card machines, printers, stands, and accessories.

“Services” refers to installation, setup, training, support, and maintenance services provided by The Local IT Guy.

“Rental Period” refers to the 24-month contract term for equipment rental.


2. Rental Agreement Terms

2.1 Contract Duration

Rental contracts are for a fixed term of 24 months from the installation date. The contract automatically converts to month-to-month after the initial term unless terminated by either party with 30 days written notice.

2.2 Monthly Payments

Monthly rental fees are due in advance on the 1st of each month. Payment must be made via debit order, EFT, or credit card. Late payments incur a 2% monthly interest charge.

2.3 Setup Fees

Setup fees are non-refundable once installation services have been rendered. Setup fees must be paid in full before installation is scheduled.

2.4 Equipment Ownership

All rental equipment remains the property of The Local IT Guy throughout the rental period. You may not sell, lease, or otherwise dispose of the equipment.

2.5 Early Termination

Early termination of rental contracts incurs the following penalties:

  • Months 1-12: 50% of remaining contract value
  • Months 13-24: 30% of remaining contract value
  • Plus return of equipment in good working condition

2.6 Purchase Option

At the end of the 24-month term, you may purchase the equipment at the following residual values:

  • Khumo: R300
  • Khumo Print: R500
  • Counter Bundle: R1,500
  • Counter Pro Bundle: R2,000

3. Support Services Terms

3.1 Support Hours

Standard support hours are Monday to Friday, 8:00 AM to 5:00 PM (excluding public holidays). Premium packages include Saturday support and after-hours emergency support.

3.2 Response Times

We commit to the following response times during business hours:

  • Basic Support: 4 hours
  • Standard Support: 2 hours
  • Premium Support: 1 hour

Response time is measured from when a support ticket is logged, not resolution time.

3.3 On-Site Visits

On-site visits are subject to availability and must be scheduled at least 48 hours in advance except for emergency situations. On-site visits are limited to the service areas specified.

3.4 Remote Support

Most support issues can be resolved remotely. You agree to provide remote access to systems when requested for troubleshooting purposes.


4. Customer Responsibilities

4.1 Equipment Care

You are responsible for:

  • Keeping equipment in good working condition
  • Protecting equipment from theft, damage, and environmental hazards
  • Using equipment only for its intended purpose
  • Not attempting repairs or modifications without authorization

4.2 Internet Connectivity

You are responsible for maintaining adequate internet connectivity. Yoco connectivity fees are paid directly to Yoco and are not included in our services.

4.3 Access and Cooperation

You agree to provide reasonable access to premises for installation, maintenance, and equipment retrieval. You agree to cooperate with troubleshooting efforts.

4.4 Staff Training

You are responsible for ensuring staff attend scheduled training sessions. Additional training sessions due to missed appointments may incur additional charges.


5. Equipment Damage, Loss, and Theft

5.1 Normal Wear and Tear

Equipment failures due to normal wear and tear are covered for rental customers at no additional charge. We will repair or replace faulty equipment within 3-5 business days.

5.2 Negligence and Abuse

Damage resulting from negligence, misuse, abuse, or failure to follow operating instructions is not covered. Repair or replacement costs will be charged to the customer.

5.3 Loss or Theft

Lost or stolen equipment must be reported immediately. Customers are liable for replacement costs:

  • Khumo: R699
  • Khumo Print: R1,499
  • Neo Touch: R899
  • Counter Tablet: R4,099
  • Yoco Printer: R2,899

We strongly recommend insuring rental equipment against theft and loss.


6. Service Limitations

6.1 Scope of Support

Our support services cover:

  • Yoco POS hardware and software
  • Product catalogue management
  • System configuration and optimization
  • Basic troubleshooting

We do not support:

  • Third-party integrations not pre-approved
  • Custom software development
  • Network infrastructure issues unrelated to POS system
  • Issues caused by unauthorized modifications

6.2 Third-Party Services

Yoco transaction processing, connectivity fees, and Yoco’s support services are separate from our services. We are not responsible for Yoco’s service availability or support quality.

6.3 Force Majeure

We are not liable for failure to perform services due to circumstances beyond our control including but not limited to natural disasters, power failures, internet outages, civil unrest, or government actions.


7. Warranty and Liability

7.1 Equipment Warranty

Equipment is covered by Yoco’s manufacturer warranty. We facilitate warranty claims but are not responsible for manufacturer warranty terms or claim outcomes.

7.2 Service Warranty

We warrant that services will be performed in a professional and workmanlike manner. If you are not satisfied with our service quality, we will re-perform the service at no additional charge.

7.3 Limitation of Liability

Our total liability for any claim arising from these services shall not exceed the total amount paid by the customer in the preceding 12 months. We are not liable for indirect, consequential, or incidental damages including lost profits or business interruption.

7.4 Data Loss

While we take precautions to prevent data loss, we are not responsible for loss of business data. Customers are responsible for maintaining their own data backups.


8. Intellectual Property

All software, documentation, and materials provided remain the intellectual property of their respective owners (Yoco, The Local IT Guy, or third parties). No transfer of intellectual property rights is implied.


9. Privacy and Data Protection

9.1 Data Collection

We collect and process personal information necessary to provide services including contact details, business information, and usage data.

9.2 Data Use

We use collected data solely for service delivery, support, billing, and service improvement. We do not sell or share customer data with third parties except as required by law.

9.3 POPIA Compliance

10. Termination

10.1 Termination by Customer

You may terminate services with:

  • Rental contracts: Payment of early termination fees and return of equipment
  • Monthly support: 30 days written notice
  • Once-off support: No notice required

10.2 Termination by The Local IT Guy

We may terminate services immediately if:

  • Payments are 60+ days overdue
  • Equipment is being misused or not properly maintained
  • Customer breaches material terms of this agreement
  • Customer engages in fraudulent or illegal activities

10.3 Effects of Termination

Upon termination:

  • All outstanding fees become immediately due
  • All equipment must be returned within 7 days (rental customers)
  • Access to support services ceases
  • Customer data may be deleted after 90 days

11. Dispute Resolution

11.1 Good Faith Negotiation

Both parties agree to attempt resolution of disputes through good faith negotiation before pursuing formal action.

11.2 Mediation

If negotiation fails, disputes will be referred to mediation before litigation. Mediation costs are shared equally.

11.3 Jurisdiction

This agreement is governed by South African law. Legal disputes fall under the jurisdiction of South African courts in Johannesburg, Gauteng.


12. General Provisions

12.1 Entire Agreement

This agreement constitutes the entire agreement between parties and supersedes all prior discussions or agreements.

12.2 Amendments

We may update these terms with 30 days notice. Continued use of services after notice period constitutes acceptance of new terms.

12.3 Assignment

You may not assign this agreement without our written consent. We may assign this agreement to affiliated companies.

12.4 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

12.5 Waiver

Failure to enforce any provision does not constitute a waiver of that provision.
